ABO Wind AG Sees Legal Hurdle Removed as Legal Action Withdrawn

In a recent development, ABO Wind AG received notice that the legal action seeking annulment against the decisions made during its Extraordinary General Meeting on 27 October 2023 has been withdrawn. This move dissolves any legal disputes against the resolutions that were passed during the meeting. The withdrawn legal action had been lodged with the Frankfurt am Main Regional Court and encompassed opposition to several significant agenda items. These included the transformation of ABO Wind's legal structure to a KGaA, an amendment to the Articles of Association for expanding the Supervisory Board, and the election of new Supervisory Board members.

With the withdrawal, the legal proceedings have concluded, removing any pending legal challenges against the resolutions of the aforementioned meeting. This update follows a release decision by the Frankfurt am Main Higher Regional Court on 29 February 2024, regarding ABO Wind’s change of legal form to GmbH & Co. KGaA.
