Federal Court of Justice Upholds Prescription Bonuses for DocMorris

In a significant legal development, the Federal Court of Justice has overturned a previous ruling by the Munich Higher Regional Court that prohibited bonuses for prescription drug dispensing. This decision was made following an appeal by DocMorris AG, dismissing an action brought against them by the Bavarian Pharmacists' Association.

The court found no substantial evidence to support claims that fixed pricing for prescription drugs was essential for maintaining patient health and drug availability in Germany. The decision aligns with a 2016 European Court of Justice ruling, which declared fixed prescription drug prices against EU law.

DocMorris will reintroduce prescription bonuses, aiming to mitigate rising healthcare costs for patients. The bonus will apply to online orders, credited quarterly. This development underscores DocMorris's commitment to reducing patient expenses without burdening the healthcare system.
