P&P Imports LLC Wins Significant Legal Victory Against Tailgating Pros

P&P Imports LLC, a prominent player in the consumer goods market with its GoSports brand, has secured a major win in a design patent infringement lawsuit against Johnson Enterprises LLC, doing business as Tailgating Pros. The judgment, issued on February 12, 2024, by the Central District of California, case no. 8:19-cv-00523-DOC-JDE, found Tailgating Pros guilty of intentional infringement, awarding P&P Imports all profits made from the sale of the infringing products.

The dispute arose when P&P Imports discovered that Tailgating Pros was marketing a knockoff version of its four-in-a-row game, distinguished by its unique size, while Tailgating Pros was presenting a smaller product that misled consumers. Represented by the legal team of Haynes and Boone, LLP, P&P Imports argued that Tailgating Pros' actions were not accidental but rather the result of intentional counterfeiting.

Casey H. Kempner, legal counsel at P&P Imports, highlighted that this verdict sends a clear message against deliberate copying and the resulting consumer confusion. P&P's management, expressing satisfaction, stated that this lawsuit held significance beyond financial losses, encompassing the protection of intellectual property and promoting fair competition.
