Zurich Court Grants File Access in Credit Suisse Valuation Case
On February 5, 2026, the Commercial Court in Zurich made significant rulings favoring plaintiffs in the Credit Suisse case. It granted them full access to unredacted documents from UBS, crucial for determining Credit Suisse's value at ongoing concern values. These documents provide insights into UBS's internal decisions before acquiring Credit Suisse on March 19, 2023, and its valuation models.
While UBS sought to limit access to heavily redacted documents, the court permitted full access under strict conditions. Physical viewing is allowed only at the court, prohibiting reproduction or third-party disclosures. UBS can appeal within 30 days or withdraw the documents within 40 days but risks adverse assessment consequences.
Additionally, the court appointed two experts to evaluate Credit Suisse's value in the context of the merger. Their report is anticipated to take time.
