Swiss Federal Supreme Court Delivers Initial Ruling on VAT Liability for Bet-at-home.com AG

On July 10, 2024, the Swiss Federal Supreme Court issued its initial judgment regarding the VAT liability of Bet-at-home.com AG's subsidiary, Bet-at-home.com Internet Ltd, based in Malta. The court ruled that the absolute limitation period for determining tax claims had expired for the 2013 tax period. However, the appeal was dismissed for other periods under dispute.

The dispute stems from the Swiss Federal Tax Administration's assertion that sports betting services offered in Switzerland are subject to VAT, estimating potential liabilities of EUR 4 million plus interest. Bet-at-home.com Internet Ltd plans to evaluate the judgment and consider further appeals.

This ruling has implications for the company's financial forecasts for 2024, but no immediate financial outflow is expected as the tax claims are suspended pending a final decision.
